Colorado DUI Process

The DUI process begins when you are pulled over on suspicion of drunk driving.  After you’ve pulled off to the side of the road, the police officer will approach your vehicle to ask for your license and registration.  At this time the police will be looking for any signs that may indicate you are intoxicated or under the influence of drugs or alcohol.  This can include open containers of alcohol in the car, the scent of alcohol on your breath, slurred speech, disheveled appearance, bloodshot eyes, and any other physical sign that may indicate you’ve been drinking.

If the officer has probable cause to believe you’ve been drinking, he or she will likely ask you to perform one or more field sobriety tests.  These tests are conducted on the side of the road and are designed to challenge your physical coordination, mental alertness, and ability to follow instructions. 

After completing the field sobriety tests the officer will either let you go on your way or ask you to submit to a breath or blood test to determine your blood alcohol concentration.  If your BAC is .08 or higher, you will be placed under arrest and charged with DUI.

Once you’ve been charged with DUI you will need to address your license suspension at a DMV hearing and your criminal charges in court.
